After More Than A Year Since It Was Slated To Begin, The Arizona Department Of Health Services Will Likely Award Certificates In August

The Arizona Department of Health Services will begin accepting applications for medical marijuana dispensaries May 14, restarting the industry that had been delayed for more than a year.

“The tumblers have clicked, and the race to apply for a dispensary is on.  Our revised rules for regulating Medical Marijuana were filed and became official today (April 11) — and we’ll be accepting applications for Medical Marijuana Dispensary Registration Certificates from May 14 through May 25,” said Arizona Department of Health Services Director Will Humble on his blog.

Voters passed Prop. 203 in November 2010 which set out the guidelines and compelled the state to enact the program. Patients and caregivers began applying for cards that allowed them to provide and use marijuana and cannabis products in April 2011, but the dispensary application process was halted by Gov. Jan Brewer in May. At the same time, Brewer directed Attorney General Tom Horne to file suit against the federal government in order to compel them to answer whether they would bring charges against state employees for overseeing a marijuana program that is in defiance of federal law.

In early January, U.S. District Judge Susan R. Bolton threw out the federal lawsuit Gov. Jan Brewer and Attorney General Tom Horne had filed that blocked the program. In her decision, Bolton rejected outright the state’s argument that the program should not be enacted because it would open state employees up to possible federal charges. Bolton cited the fact that 16 other states had implemented similar programs and not one state employee has yet been targeted.

In response to Bolton’s ruling, Gov. Jan Brewer instructed Humble to restart the dispensary application process. Yesterday’s announcement that applications will be accepted from May 14 to 25 is the culmination of that order.

Humble said in his blog yesterday that he believes the state will award its first dispensary applications in early August.

“We’ll have 30 working days to review the applications, and applicants will have 20 working days to submit any documents or information that were missing during our review of the application.  We expect to award Medical Marijuana Dispensary Registration Certificates on Aug. 7.  If there’s only one qualified applicant in a CHAA, that applicant will be awarded a Registration Certificate.  We’ll be holding a random drawing in early August to award Registration Certificates in CHAAs with more than one qualified applicant,” Humble wrote.

The rules the Arizona Department of Health Services, or ADHS, issued yesterday are different than those that would have dictated the dispensary application process last year, however, thanks to a judge’s ruling in Compassion First v. State of Arizona. In that case, Maricopa County Judge J. Richard Gama ruled the ADHS overstepped the authority the Act granted it to create rules by requiring applicants to have been an Arizona residents for three years, that applicants have never filed personal or corporate bankruptcy, that applicant have submitted Arizona personal income tax returns for previous three years, and that applicants are current on court-ordered child support; is not delinquent in paying taxes, interest or penalties to the government; does not have an unpaid judgment to the government; and is not in default on a government-issued student loan.

Gama did rule that some of the rules challenged by Compassion were eligible under the Act’s diversion and theft provision. Gama specifically cited three rules: that individuals with 20 percent or more interest in a dispensary be the applicant or principal officer or board member of  dispensary; mandating documentation of ownership of address of dispensary or permission from owner for applicant to operate dispensary at the address; and requiring the application to comply with state law.

Those requirements are part of the rules released yesterday. Other significant items in the rules are that a random drawing will be held when multiple applications are received for a CHAA, combined with meeting criteria. What that means is if more than one application is received for a CHAA, the ADHS will first check if the applicants have listed all members of the board of ownership and will then move on to whether they have proof of access to $150,000. If more than one application meets those two requirements, then those who do not will not be eligible for the random drawing.

The $150,000 requirement was considered onerous by some hopeful ‘mom and pop’ applicants when the state when through the public comment process for the rules in 2011. Other, more established organizations, however, sought to make the application requirements a filter that would screen for those who could bring the best and most responsible dispensaries.

“I am glad that the Arizona Department of Health Services is finally executing the program as it was designed, as a trifecta of qualified patients, caregivers, and dispensaries. However, the Medical Marijuana Fund has a large surplus of capital at this time and we feel that these resources could be used to evaluate the quality of applicants rather than using a random license assignment process in CHAAs that have more than one applicant.  Although dispensaries are subject to market conditions just like any other business or organization, the Department has the authority to regulate this industry using best practices from other states and should choose to do so as it will be subject to scrutiny until it is rescheduled by the Federal government,” said Moe Asnani, partner, Arizona Dispensary Solutions.

Humble told the Arizona Republic that it was his impression that the “land-rush” mentality that was widely reported last year had appeared to wane with the delay.

“I just don’t sense the same land-rush type of attitude that we had a year ago,” Humble said to the Arizona Republic. “I don’t think we’ll be overwhelmed with applications.”

Doug Banfelder of Premier Southwest Insurance Group, one of the few providers of insurance for dispensary applicants, said that while they may not be such a “land-rush” mentality, what remains is a core group that are hoping to open multiple dispensaries.

“The people that are involved now are people that have been with us from the beginning. They have deeper pockets and have higher functioning teams that didn’t fall apart due to the stress of waiting.”

Banfelder said that unless the groups intending to open a dispensary have had a location approved by a municipality and have acquired a conditional-use permit, their prospects of opening a dispensary are probably slim. A potential applicant in that situation would only have 20 working days past May 14 — or slightly less than 60 days to find a location and have it approved by a landlord and a municipality.

“What we are looking at is a situation where those teams that have deep pockets and real estate connections will have additional opportunities. So, some of them are looking at other opportunities,” he said.

Banfelder said now that dispensaries will be awarded, however, the next evolution in the state’s medical marijuana industry will be between law enforcement and dispensary owners. He said with dispensaries slated to open before Christmas, questions over whether prosecutors will allow cannabis lozenges and tinctures and other potential legal loopholes need to be resolved before law-abiding dispensary owners find themselves in court.

“It would be nice if the county attorney and the attorney general would offer some guidance to the industry because nearly everybody on the industry wants to be compliant and so those with prosecutorial powers also have the power to educate those in the industry who seek compliance,” Banfelder said. “They can either offer guidance so those who want to operate legally, can.  Or they can lie in wait and play a game of gotcha.”

PHOENIX – On Friday morning, Arizona Gov. Jan Brewer says she will not refile a federal lawsuit asking for a ruling on whether the state can carry out its medical marijuana law.

The law has been in limbo since voters approved it last year.

She said the state will start accepting and processing applications for dispensaries — once a legal challenge to the state’s rules is resolved. That case is pending in state court.

So, it is still not clear when marijuana dispensaries could actually start selling marijuana.

FERNDALE, Mich. (WJBK) — It looked like the stash seized in any other drug raid when the Oakland County Sheriff’s Department showed us medical marijuana taken from Clinical Relief, a dispensary that used to operate on Hilton in Ferndale.

Now, nearly a year and a half after the raid, there is relief for seven workers who faced felony charges. Oakland County Circuit Judge Daniel O’Brien has dismissed the case.

“At the time our clients acted, they had no reason to believe that their interpretation of the medical marijuana act was not appropriate and not correct,” said attorney Neil Rockhind.

That’s what he has been arguing in court for months, and the judge agreed.

Clinical Relief was the first dispensary raided back in August of 2010. Since then, Michigan’s Court of Appeals has ruled person to person medical marijuana sales through dispensaries are illegal, but at the time of the charges that ruling had not yet been made.

We spoke to one of the former workers that was charged in the case. She told us she’s happy with the judge’s decision, and while she admits some medical marijuana facilities are exploiting the law to make a profit, she says she and the people who worked at Clinical Relief only intended to help people.

“There are sick people who have multiple sclerosis. There are other people who are just caught in the middle, and that’s not fair to them,” Rockhind said.

He calls the judge’s decision courageous, but Oakland County Prosecutor Jessica Cooper disagrees and plans to appeal.

Other medical marijuana cases are still being reviewed by the state’s higher courts, including the Michigan Supreme Court, and drug charges are still pending against other people busted for dispensing medical marijuana.

A new study has found smoking marijuana isn’t as harmful to the lungs as smoking cigarettes.

Researchers at the University of Alabama at Birmingham found that occasional marijuana use even improves lung capacity after studying a national database.

The news wasn’t surprising for many people in San Luis Obispo, which was the first city in the nation to ban indoor smoking in public.

“Marijuana feels more relaxing, and I know I’m not destroying my lungs,” said Naomi Rodriguez, who was visiting from Los Angeles.

Similarly, Elaine Simer said as long as it was in moderation, she didn’t see a problem with it.

“If you take a puff every once in a while, I don’t think it’s going to hurt you,” she said.

Phillip Borges, a Fresno resident visiting San Luis Obispo, agreed.

“It helps you work harder, and you don’t get stressed out as easy,” he said. “You don’t get mad at people. You let things go that normally you wouldn’t.”

However, a San Luis Obispo doctor says deciding between smoking marijuana and smoking cigarettes is like choosing between the lesser of two evils.

Dr. Dane Howalt says think twice before you light up to calm down, even if it’s for medical reasons.

“When was the last time your doctor told you to smoke your medicine?” he said.

He says it’s not surprising the smoke from marijuana is less toxic than the smoke from cigarettes.

“In terms of overall being safer or less of a health problem, it isn’t hard to be less of a health problem than cigarettes,” he said.

Howalt says he could see the benefits of medical marijuana if there was a standardized oral form of it, but smoking anything isn’t good.

“You can phrase something in such a way to make it sound like a certain substance is actually much better than something else, and therefore, that would mean it was good,” he said.

The evidence in the study wasn’t strong enough for researchers to recommend marijuana as a treatment for better lung health. Experts also say using marijuana increases the risk for heart attack and can impair the immune system.

DENVER—Federal officials on Thursday began a California-style crackdown on medical marijuana dispensaries in Colorado that targets those located near schools, setting up a possible showdown with businesses that worked closely with state lawmakers to develop regulations they hoped would prevent such an action.

U.S. Attorney John Walsh said 23 dispensaries within 1,000 feet of schools have until Feb. 27 to shut down or face federal penalties, which can include asset seizure or forfeiture of property. The warning letters dated Thursday were being sent to dispensary owners and their landlords.

He said the letters were a first step and prosecutors were looking for medical marijuana businesses to target near schools. Walsh’s office declined to release a list of targeted businesses, saying they do not make public individuals under investigation.

Rob Corry, a Denver lawyer who represents dispensaries and was a member of a task force that wrote Colorado’s regulations, said some of his clients have received letters. He said he advised them to fight the threats, which he called a “massive bluff.”

“(Walsh)’s declaring war on state lawmakers who set up a highly regulated medical marijuana industry,” Corry said. “There’s an entire state bureaucracy devoted to this, not to mention thousands of jobs and countless sick people.”

State regulations prohibit medical marijuana businesses within 1,000 feet of schools but grandfathered in those businesses already in existence before regulations were passed in 2010.

Sixteen states have passed laws allowing medical marijuana, beginning with California in 1996. Unlike California, Washington, and Montana, where federal officials have cracked down on businesses sanctioned by the state, Colorado’s industry is heavily state-regulated. A ballot measure is pending to make it legal for recreational use, and state officials have asked the federal government to recognize the herb as medicine.

“When the voters of Colorado passed the limited medical marijuana amendment in 2000, they could not have anticipated that their vote would be used to justify large marijuana stores located within blocks of our schools,” Walsh said.

In California, four U.S. attorneys sent similar letters to dispensaries, with some of them closing. It was unclear what actions were taken by authorities against those that didn’t close or move.

Colorado’s medical marijuana industry began its boom after a September 2009 memo by then-Deputy Attorney General David Ogden that said federal prosecutors should not focus investigative resources on patients and caregivers complying with state laws. But faced with dispensaries and states passing laws regulating medical marijuana, Ogden’s replacement, James Cole, in June issued another memo that took a tougher stance and said state medical marijuana laws do not provide immunity from federal prosecution.

He said commercial enterprises that sell or profit from marijuana sales should be a priority. He reinforced that cancer patients and caregivers shouldn’t be targeted.

Colorado’s attorney general, John Suthers, who opposed regulations under the argument that they legitimize an illegal enterprise under federal law, said he long warned lawmakers of the clash between state and federal law.

“I would expect the federal government having jurisdiction, to do what they think is necessary to limit drug problems in the state of Colorado,” Suthers said in a recent interview with The Associated Press. “I’m not going to oppose it.”

Colorado has more than 600 retail shops, 900 cultivations and 230 infused product manufacturers operating under state law, according to the state revenue department. A spokeswoman for the department’s Medical Marijuana Enforcement Division did not immediately return a call Thursday.

Samantha Beckmann manages a dispensary across from a high school, with the school’s baseball fields on the other side of a crosswalk of a busy street. She said the U.S. attorney’s action is discriminatory because it singles out certain dispensaries.

“We will move. We will make it happen,” she said. “If they’re going to do anything, they should shut everyone down. They shouldn’t discriminate.”

Outside the Colorado state Capitol, about three dozen marijuana activists rallied as Democratic Gov. John Hickenlooper gave his annual State of the State address. The governor did not mention pot, though he signed a marijuana regulation law last year and his administration recently joined other states in asking the Drug Enforcement Administration to reclassify marijuana so that it could be considered a medical treatment.

A community organizer at the marijuana rally said he wasn’t surprised by the crackdown. He blamed state authorities and the state’s larger marijuana businesses for setting up elaborate rules for how medical marijuana can be bought and sold.

“They set up all these rules and now they’re coming back to pinch them in the butt,” said Miguel Lopez of The Denver 4/20 rally, which attracted 20,000 people last year. Lopez favors full legalization for the drug, not Colorado’s system of dispensaries regulated by the state Department of Revenue.

PHOENIX – A program that’s been in legal limbo for about a year — Arizona’s medical marijuana program — could be one step closer to becoming a reality.

A federal judge has dismissed Arizona Gov. Jan Brewer’s lawsuit asking for a ruling on whether the state can implement its medical marijuana law in the face of marijuana still being prohibited under federal law.

U.S. District Judge Susan Bolton’s order Wednesday says the case isn’t legally eligible for court consideration. She says that’s because the state hasn’t established there’s a genuine threat of prosecution of state employees for administering the law.

That’s good news for attorneys like Ryan Hurley, who represents those who would open dispensaries.

“What happens now is certainly the biggest question. Its not quite a green light as of yet, certainly the governor needs to give that green light. We think its a great opportunity for her to move forward, this is sort of the last stumbling block,” says Ryan Hurley from Rose Law Group.

Attorney General Tom Horne’s office was silent on the ruling, and the governor’s spokesperson is telling the media they still feel state workers would be in danger of prosecution.

They have 30 days to refile, but Judge Bolton specified that their argument has to be more than the fear that state employees would be thrown in jail by the feds — something the judge stated has never happened.

Bolton’s order dismissing the case grants motions filed by the federal government and supporters of the medical marijuana law.

The Federal Government officially responded to Arizonan citizens and employees this morning. This statement turned out to be everything it was expected to be–not much. While you are licensed by the state of Arizona to grow marijuana, the Federal Government will still be openly prosecuting individuals who engage in forms of crime like marijuana-related money laundering, and large-scale distribution of marijuana. The situation is no different in any other state regarding the Federal policy on marijuana.

However, July 1st will also be remembered as the day that Ahwatukee received a zoning “OK” from the Phoenix Zoning Board. This is a big step toward supporting the dispensary models that Arizona patients need for quick and easy access to medicine.

TUCSON, Ariz. — Another legal battle is heating up over the state’s medical marijuana law.

Arizona attorneys have filed a lawsuit demanding the State Health Department accept applications from potential dispensary owners.

That was supposed to start happening June 1, but health officials refused after the state filed a lawsuit against the federal government over the legality of the program.

“The ultimate goal here is to require the dept of health services to publish the application they set forth and say they will accept and consider the applications,” said Ken Frakes from the Rose Law Group.

Attorneys say right now the only option is for patients to grow medical marijuana on their own or rely on others to grow it in their homes.

Arizona Medical Marijuana Certifications is coming to Mohave County June 17-18th to see Lake Havasu, Bullhead City, and Kingman Medical Marijuana Qualified Patients

Arizona Medical Marijuana Certifications (Arizona MMC), the state’s premier AZ Medical Marijuana center, will be seeing patients in Kingman, AZ June 17-18 at the Holiday Inn Express.

Hours for the evaluations are Friday from 3pm to 8pm and Saturday from 8am to 8pm in the meeting room. The address for the Holiday Inn Express is 3031 E Andy Devine Ave, Kingman, AZ 86401.

The Kingman visit will serve qualified patients in Kingman, Lake Havasu City, and Bullhead City. As a requirement in Arizona, patients need to have an in-person examination from a licensed doctor and a review of the past 12 months of medical records for the qualifying condition.

With the passing of Prop 203, medical marijuana is now legal in Arizona for qualified patients with debilitating medical conditions. Patients with Cancer, Severe Nausea and Vomiting, Chronic Pain, Severe Muscle Spasms, Glaucoma, Hepatitis, HIV or AIDS, Crohn’s Disease, MS or ALS, Cachexia or Wasting Syndrome, or Alzheimer’s Agitation may qualify for an Arizona Medical Marijuana Card.

Most medical marijuana in AZ evaluation centers do not provide the services that Arizona MMC does for its patients. These include the following:
